State land-use opinion (dictamen técnico de uso de suelo)
A technical opinion from the BCS state government that the use you plan (for example, a single-family home) fits the urban-development plan for the lot.
Why it matters
The municipality asks for the state dictamen before it issues its land-use approval, and the building permit needs both.
Who helps
Gobierno de BCS, Dirección de Planeación Urbana (Dirección General de Planeación), Palacio de Gobierno, 2nd floor, La Paz. A gestor or your builder usually files; closing law firms often don't handle permits.
What to do: Request the state land-use opinion before the city land-use approval.
Documents
- Signed request from the owner or an accredited representative: intended use, lot area, clave catastral, contact details and an ID copy.
- Deed recorded at the RPPC and a current predial receipt.
- Poder notarial and ID for any representative. With a fideicomiso the bank is the owner, so you need the bank's power of attorney (step 4.3).
- Acta constitutiva, if the owner is a company.
- Survey plan: 3 printed copies showing dimensions, a location sketch, scale, a coordinate table, neighboring lots and contour lines, in UTM coordinates (ITRF92 or WGS84). Add a USB drive with a KMZ file and an Excel coordinate table, plus recent photos. Say whether the lot is a fraction of a larger polygon.
Costs Estimate
- State dictamen: MXN 3,073 (about USD 165), confirmed in the 2026 flowchart.
- Response: about 15 business days.
Estimates only. Get written quotes.
Common mistakes
- Filing in your own name when the bank (fiduciaria) is the legal owner.
- A survey without UTM coordinates or without the KMZ and Excel files on USB.
- Assuming the municipal approval is the first step.
